SportsHL LLC (“Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using the SportsHL website, mobile applications, or other online services (collectively, the “Platform”) if such claims are reported to our Designated Copyright Agent identified below.

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Platform by completing a DMCA Notice of Alleged Infringement and delivering it to our Designated Agent.

1. DMCA Notice of Alleged Infringement

To file a valid notification of claimed infringement with SportsHL LLC, you must provide a written communication (via email or physical mail) that includes substantially the following information:

  • Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., a precise URL or link to the specific content).
  • Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
  • Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification Procedures

If you receive a notice that content you posted on the Platform has been removed or disabled due to a DMCA claim, and you believe this action was taken as a result of mistake or misidentification, you may submit a written Counter-Notification to our Designated Agent.

To be effective, your Counter-Notification must include:

  • Your physical or electronic signature;
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for Kootenai County, Idaho, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid Counter-Notification, we will forward a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, user, or member, the removed material may be replaced, or access to it restored, in 10 to 14 business days after receipt of the Counter-Notification.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, SportsHL LLC maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users, members, or content providers who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
